Terms of Service
These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for use of the WebMemorySheet application (hereinafter referred to as the “App”) provided by Yuki Ishino (hereinafter referred to as the “Provider”). By using the App, users are deemed to have agreed to these Terms.
Article 1 (Application)
- These Terms apply to all relationships related to the use of the App between the user and the Provider.
- In addition to these Terms, the Provider may establish individual terms of use (hereinafter referred to as “Individual Terms”). Such Individual Terms shall constitute a part of these Terms.
Article 2 (Fees and Payment Methods)
- The App is a paid service. Fees, payment methods, and billing timing shall follow the descriptions provided in the app stores (App Store / Google Play, etc.).
- In principle, payments are non-refundable after the completion of the payment process, except as required by law.
Article 3 (Prohibited Acts)
Users shall not engage in any of the following acts when using the App:
- Acts that violate laws or public order and morals
- Acts related to criminal activity
- Acts that interfere with the servers or networks of the App
- Acts that cause disadvantage, damage, or discomfort to other users or third parties
- Acts that hinder the operation of the App
- Unauthorized access, reverse engineering, or data extraction
- Any other acts that the Provider deems inappropriate
Article 4 (Changes to the Service)
The Provider may change, add, or discontinue the content of the App with prior notice to the user, and the user agrees to this.
Article 5 (Usage Restrictions and Account Termination)
The Provider may, without prior notice, temporarily or permanently suspend a user’s use of the App if any of the following applies:
- Violation of these Terms
- False information in the registration details
- Any other reason deemed inappropriate by the Provider
Article 6 (Disclaimer)
- The Provider makes no explicit or implicit guarantees that the App is free from factual or legal defects (including but not limited to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, and security issues such as bugs, errors, or infringement of rights).
- The Provider shall not be liable for any damages incurred by users arising from the use of the App, except in cases of intentional misconduct or gross negligence.
- The Provider is not responsible for the content of any third-party websites or services linked from the App.
- In the event that the Provider is held liable for damages, the liability shall be limited to the total amount of usage fees paid by the user in the month in which the damage occurred.
Article 7 (Intellectual Property Rights)
All intellectual property rights, including copyrights, related to the contents (text, images, programs, etc.) included in the App belong to the Provider or to a third party with legitimate rights. Users shall not infringe on such rights.
Article 8 (Amendment of Terms)
- The Provider may change these Terms without obtaining the user’s individual consent in the following cases:
- When the changes are in the general interest of the user.
- When the changes do not conflict with the purpose of the user agreement and are reasonable in light of the necessity, content, and other circumstances.
- In the case of amendments under the preceding paragraph, the Provider will notify users in advance of the fact of the change, the revised content, and the effective date.
Article 9 (Prohibition of Assignment of Rights and Obligations)
Users may not assign or provide as security their contractual status under these Terms or any of their rights or obligations under these Terms to any third party without the prior written consent of the Provider.
Article 10 (Governing Law and Jurisdiction)
- These Terms shall be governed by the laws of Japan.
- Any disputes arising in relation to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Provider for the first instance.
